  • 1.  What causes of action? Separate suit?

    Client was falsely accused of inappropriately touching his child. Multiple evaluations (State and private) over a three-year period have all come to the conclusion that the child was directly coached and no abuse occurred, and a judge just agreed, in one of the most blistering opinions I've ever seen, that this was an invention by mom to gain an advantage in custody / parenting time litigation.

    1. Client bankrupted himself (literally), has gone through hell (in therapy, etc), missed time with his daughter (who was also damaged by this).

    What causes of action exist?
    <x-tab>        </x-tab>- Defamation (if allegations shown to have been made to others outside the legal process)
    <x-tab>        </x-tab>- Intentional infliction of emotion distress
    <x-tab>        </x-tab>- Negligent infliction of emotion distress

    ... Any others?

    2. Client wants to assert damages on behalf of his daughter and seek the establishment of a trust for her future therapy / psychological care.

    3. The matter is many years post-judgment. Should a tort claim be a separately-filed action, or brought under the FM docket?

    Dave:

    I think the tort claims should be filed in the Law Division. Let the defendant try to have it removed to the family part. The causes of action you set forth do not arise out of an agreement you are seeking to enforce. 

    I am not sure of the defamation cause of action without more facts, but the mental distress claims are good and abuse of process may apply. 

    I also think you might need a guardian appointed for the child.

    That is very sad, did the father get primary custody of the  child?
