    Good afternoon Family Law Section members,

    On Wednesday, June 10, NJICLE in cooperation with the Family Law Section and LGBT Rights Section will present Webinar- Overview of S3528/A5396: Expanded Adoption Access for LGBTQ Families from 12 to 1 p.m.

    New Jersey's birth certificates don't establish parentage, they are only proof of birth. Under NJ's Parentage Act, a biological parent's spouse or civil union partner may be listed on the birth certificate, but this does not establish parentage for the non-biological parent that other states will recognize through full faith and credit. Several United States Supreme Court case have confirmed that a judgment of adoption must be recognized by all states as proof of legal parentage.

    LGBTQ couples or different-sex couples that have used donor gametes, therefore, need to obtain judgments confirming their parentage so they are protected if they travel or move. Getting a "confirmatory" adoption decree was often costly and time consuming for couples, requiring legal services, court appearances and background checks. Governor Murphy recently signed S3528, which streamlines the process of obtaining the judgment confirming parentage, making it easier and less expensive for couples and assuring them that their parentage will be recognized if they travel or move. Our informative lunchtime webinar reviews what the bill covers and how lawyers and parents should proceed going forward.
