    Good afternoon Family Law Section members,

    On Wednesday, April 6, NJICLE will present Webcast- How to Draft Effective and Efficient Retainer Agreements from 12 to 1:40 p.m.

    Attorney client relationships are based on many factors but underlying them all is a business transaction with ethics implications. Like all business transactions, payment for services rendered is an essential factor. But as billing systems and retainer agreements have become more complicated, they have also come under greater scrutiny, especially when it comes to provisions for contingency fees, fee arbitrations and fee shifting.

    Join us for a webinar that is the essential guide to retainer agreements, with the latest information and the latest opinions. Experienced practitioners will first provide a refresher on the basics, such as the critical elements that all retainer agreements should include and options for different types of fee agreements.

    Then, the presenters will discuss specific clauses and problems as well as recent caselaw and ethics opinions.

    • The basics - A review of RPC 1.5 and a refresher of what must be in a retainer agreement.
    • Specifics for personal injury cases – clauses for plaintiff and defense attorneys
    • Standard clauses for matrimonial agreements
    • Fee arbitration – issues raised by Balducci vs. Cige
    Kopec v. Moers – the recent Appellate Division opinion that consolidated 10 back-to-back appeals dealing with post-judgment enforcement motions in the Chancery Division for unpaid fees. The Court denied the motions and issued opinions on proper venue for those motions, proof of reasonableness of the fees requested and the importance of clear, unambiguous language.

    CLE Credits:
    NJ CLE information: This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 2.0 hours of total CLE credit.
    NJ CLE: This program has been approved for 2.0 credits (50 minute hour)
    PA CLE: 1.5 substantive credits pending ($8 fee – separate check payable to NJICLE must be submitted at the end of the program)
    NY CLE (t): 2.0 practice management credits

    The tuition for NJSBA members is $99. The general tuition is $125.
