    Good afternoon Family Law Section members,

    On Thursday, Jan. 21, NJICLE in cooperation with the NJSBA Immigration Law Section, NJSBA Senior Lawyers Special Committee and NJSBA International Law and Organizations Special Committee will present Webcast- Family Based Immigration and Immigration Law Practice in 2021 from 9 a.m. to 12:35 p.m.

    For decades, U.S. Immigration Law has promoted family unification and allowed permanent residents and U.S. citizens to sponsor relatives to come to the U.S. with green cards. That's still the case, while the road for these benefits was quite bumpy during the Trump Administration. There is still a strong desire to shift to a system that emphasizes merit and points, similar to the Canadian and Australia systems, rather than family ties, as a basis for admission to the United States. Due to Trump's Proclamations, the U.S. issued fewer Family Visas and there were extended wait times for the processing of family applications. New rules that were recently issued allow immigration officers to use enhanced criteria when deciding if an applicant is likely to become a public charge. Additionally, new "discretionary" guidelines leave officers to make determinations about green card cases that may seem "arbitrary and capricious".
