    Good afternoon Family Law Section members,

    On Tuesday, Feb. 28, NJICLE will present Webcast- Dividing Retirement Assets in Divorce: When You Need a QDRO, When You Don’t and How to Understand One When You Do from 1 to 4:35 p.m.

    Dividing retirement assets is often a major part of any martial property settlement in a divorce.  Many divisions require a QDRO, a qualified domestic relation order, in addition to a property settlement, depending on the type of retirement plans involved. A QDRO allows a pension plan administrator to transfer plan assets from a titled spouse to a non-titled spouse after a divorce has been finalized. The QDRO must comply with both the terms of the property settlement and the pension plan rules. Failing to obtain a QDRO when one is needed, or drafting one incorrectly are serious mistakes and can open the attorney to malpractice claims.

    Our informative seminar will review the types of retirement plans that need a QDRO, and the calculations and methodologies used by pension administrators to distribute pension assets. Our panelists also provide important information about how New Jersey State Retirement system, Military Pensions and Federal Civilian Pensions are treated in divorce settlements.
