Hello. I have a client with a potential trademark issue as they were sent a "cease and desist" letter accusing them of trademark infringement. Going back to my law school days, I did not think you could trademark the name of a town and a specific type of business. By way of example only, let's say "East Brunswick Florist", trademark that specific generic name and then tell all florists in East Brunswick that they cannot use that term for online searches even if their particular website name does not include this phrase thus not misleading the general public in any way. I have researched the issue online and there appears to be a difference of opinion on the subject.
Does anyone have any thoughts on this or know a good trademark attorney in the Ocean/Monmouth County Area?
