    NOTICE TO THE BAR
    CERTIFIED JUDGMENTS OF DIVORCE - NO FEE FOR INITIAL COPY
    This notice sets forth clarification of the process for a certified copy of a judgment
    of divorce in the Chancery Division, Family Part.
    Where an attorney or litigant furnishes a copy of the judgment of divorce, the
    Superior Court Clerk or designee shall certify that the judgment is a true and accurate
    copy of the judgment filed in the Superior Court. That one certified copy shall be
    provided at no cost to the person requesting the certified document. Thus, each
    attorney or self-represented litigant shall be entitled to one copy of the judgment of
    divorce at no charge.

    Is that for a copy with a gold seal or just a stamp stating it is a certified true copy?

    Judge Grant was at the NJSBA Board of Trustees meeting and we asked him that very question. It is for a GOLD SEALED certified copy. We are hopeful he sends out a clarifying notice including the words "gold seal". We asked that he do so and he indicated he would.

    I received a " free" gold seal' in Middlesex County on Wednesday. So did the Defendant who did not file an Answer or Appearance.

    Michelle Smith came to a recent Union County Bar Association event. She said that the State is moving away from the gold seal.

    By now, some of you may know that there is a much more significant case that probably will be filed soon. This goes way beyond gold seal fees.

     

    However, I do understand Judge Grant met with the State Bar trustees today so I don't have any information other than the gold seal fee repeal.

    Rob, we were told today by Judge Grant that the gold seal will eventually be going away when e-filing starts and instead there will be a blue seal placed on the document electronically. I don't see us efiling though any time soon.

    Seriously?   Aside from the fact that this will probably not happen in my lifetime, has anyone considered how this will affect QDRO's and the like with out of state people who expect that gold raised seal in order to qualify the order?

    We raised that too. We were told there would be a Court rule evidencing the change so that we can send a copy of the court rule to plan administrators, DMV and the like as they are used to the gold seal. Again, we appear far away from efiling and instead are focused on fighting these fee changes first.

    I think the federal courts do something like that with the colored seal for electronically filed documents.

    I didn't receive a "free" gold seal in Middlesex County when I divorced my client early this month. In fact, she had to pay for her copy and they wanted payment in "cash" only : (. I wonder if she can get her money back?
