    Hello Family Law Section members,

On Wednesday, Aug. 1, NJICLE will present The New Jersey Gestational Carrier Act 2018: The Future of Family Formation from 9 a.m. to 3 p.m. at the New Jersey Law Center.

Science and law haven't always developed in sync, particularly in the area of reproductive technology. Today, both medically and socially infertile couples - and single people who desire to form a family - often turn to a gestational carrier to have a child. Up until recently, gestational carrier arrangements were unenforceable in New Jersey, but now that has changed. On May 30, 2018, Governor Murphy signed the Gestational Carrier Agreement Act, Senate Bill S482, which makes gestational agreements that conform to the provisions of the bill, enforceable. At the birth of the child, the intended parents are now contractually recognized as the legal parents of the child, and the gestational carrier has no parental rights or obligations, eliminating any questions about custody and responsibility for the child.
