Hello Family Law Section and Solo and Small-Firm Section members,

The New Jersey Institute for Continuing Legal Education and the NJSBA Family Law Section are presenting The Child Support Guidelines: How to Advocate to Deviate on Saturday, Dec. 14 at the New Jersey Law Center from 9 a.m. to 12 p.m.

Children are entitled to support by their parents, whether the parents are married or not. Like many states, New Jersey uses guidelines that consider family size, income levels and custodial status of the parents for determining support awards. But the guidelines are just that, guidelines, and many circumstances, such as the disability of a parent or a child or long term unemployment justify deviating from the guidelines. Astute family lawyers know how to advocate aggressively for a digression when they believe such a petition has merit.

Guideline revisions were announced this fall. The changes include a lowering of some guideline amounts. Our informative seminar reviews the status of the anticipated changes, examines the methodology used in establishing the guidelines and takes a hard look at how to advocate for a deviation from the guidelines.

Hear the latest on changes to the child support guidelines and how to properly advocate for your client, including:
    • A review of the status of anticipated changes
    • How to use the case information statement (CIS) and tax returns to build a case for deviation
    • How and when to present a deviation request
    • Examining the adequacy of the award
    • How social security income can impact child support
NJ CLE information: This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 3.3 hours of total CLE credit. Of these, 3.3 qualify as hours of credit toward certification in matrimonial law.
