  • 1.  Tevis Jury Trial Experience

    I am scheduled to begin a Tevis Jury trial before a matrimonial Judge.  Although I have tried my share of both matrimonial cases and jury trials, I have never tried a Tevis case before a Jury in the Family Court.  Furthermore, even though Tevis was decided more than 40 years ago, I can't seem to find any attorney who has actually tried a Tevis Jury trial to conclusion in the Family Court.  If anyone has had this experience (either for the alleged victim or the alleged aggressor) I would like to her from you with regard to what procedures were followed.  Thank you.

    A Tevis jury trial in the family part is just like a personal injury civil jury trial.  Know your law and proofs/evidence, prepare for direct and cross, open and closings, and jury charges etc.

    Trying a Tevis claim is not trying a “tevis” claim as Alice pointed out. You are trying whatever the claim is i.e. assault, personal injury, intentional tort. So you have to prosecute or defend same as you would in the law division. Know the elements of the claim. Don t forget summary judgment.

    Thanks Allen.  To elaborate on what Allen said -- be prepared for jury selection (read the court rules), motions in Limine, summary judgment motions (pre-trial), trial brief, experts, testimony, evidence, opening and closings, jury charges.
