    Something Old, Something New, Something Borrowed for Review: Inside the Work of the New Jersey Law Revision Commission

    About the Program

     

    Did you know…

     

    • Until 1991, laws dating from the early 19th century provided remedies for trespass by swine on your property, allowing you to kill the offending animals and deliver the meat to the county overseer of the poor (4:21-8 to 4:21-10)

     

    • Until 2014, New Jersey law limited the amount to be spent for feeding a prisoner in county jail to $0.50 a day (30:8-14)

     

    • It was also, until 2014, a criminal offense to refuse to yield a telephone party line to someone who needed to make a telephone call in an emergency (2C:40-2)

     

    These are examples of the anachronistic laws that seem to attract the most attention to the New Jersey Law Revision Commission. Identifying and recommending these laws for repeal is an interesting, but small, part of its mission.

     

    The Commission works in both the civil and criminal areas of the law. Its projects may concern a single subsection of a statute, an entire title, or many titles. Recently enacted laws based on the work of the Commission include:

     

    • Uniform Trust Code (2015)

    • New Jersey Family Collaborative Law Act (2014)

    • Replacement of Pejorative Terms (2013)

     

    The Commission is charged with the responsibility to "promote and encourage the clarification and simplification of the law of New Jersey and its better adaptation to social needs, secure the better administration of justice and carry on scholarly legal research and work." N.J.S. 1:12A-8.

     

    A panel of NJLRC attorneys will provide you with insight into the history and work of this little-known Commission. Hear directly from Laura C. Tharney, Jayne J. Johnson, Vito J. Petitti, and Samuel M. Silver regarding what the Commission does, why they do it, and how members of the legal community can participate in its work to impact recommendations to the Legislature.
