In May, I posted regarding a disappointing appellate division decision. In sum - A generally very good judge, but, especially at the time, one who was overworked and understaffed (with only 2 FM judges for a calender that kept 4 FM judges busy) copied numbers incorrectly from the record into the CSG software, calculated support on the sole rather than shared worksheet in spite of shared parenting, and made other errors. I was retained just after the deadline ran to file for reconsideration and took it up. To my great surprise, the App Div affirmed. It then denied a motion for reconsideration without explanation. Thus my post here.
I received several replies, off list and on, on the process for seeking Supreme Court review ... along with being reminded of the discouraging odds that the Supreme Court do anything about it at all beyond "cert denied."
Well... obviously I wouldn't be posting this if the news were bad. We got the decision today - the Supreme Court summarily remanded for the trial court to take another look at it, and retained jurisdiction.
Never give up when you're right, as I've heard said here before. :-)
