It's one of those things "we know" that evaluators will send their raw data (notes, questionnaires, etc) only to a new evaluator, not to counsel, but client is challenging me (rightly) on why we can't get it directly for preparing for depositions and/or cross. I didn't have a solid answer.
Is there a specific case or Rule on subpoenaing the raw data used by a custody evaluator?
