    Greetings Listmates:


    I need to issue a subpoena at Amazon.com. Amazon is a Delaware corporation
    with its principal place of business in Seattle, Washington. According to
    the NJ Secretary of State website, there is no registered agent in NJ.


    My research thus far leads me to believe that because the states of
    Washington and New Jersey have enacted the Interstate Depositions and
    Discovery Act (IDDA), that I do not have to go through the formality of
    obtaining letters rogatory or a commission for an out of state subpoena.
    That being said, I believe my next step would be to file the subpoena with
    the Thurston County Clerk's Office (in Washington) via an
    overly-complicated process that includes taking a "test" so that I can
    efile the subpoena.


    My question: Has anyone has success with this process? Before I go ahead
    and start the process, I would love to hear if anyone has any feedback on
    this.

    I think you're complicating it unnecessarily.  Amazon maintains a physical presence in New Jersey and thus can reasonably expect to be hailed into our courts Remember that Pennoyer v. Neff, first day of law school stuff?  International Shoe, etc.  Or, in the Family Part, Sharp v. Sharp,http://scholar.google.com/scholar_case?case=11810615816895101201.

    I've never subpoenaed Amazon, but they're on a small list of folks I've never issued a subpoena to.  The only company that has given me a problem is Barclay's Bank, who asserted a jurisdiction issue.

    Assuming your case is prejudgment or a plenary hearing has been ordered post-judgment (thus giving authority to issue a subpoena), all you need to do is personally serve it (anyone over 18 not interested in the litigation can do it, or call Guaranteed Subpoena or your preferred company) on one of Amazon's NJ locations.  Here's two of them, there may be more:

    Have whoever serves it get the name of the person receiving it.  I wager that you will shortly hear from their legal processing department.

    One other general note on subpoenas based on a recent conversation with Wells Fargo: If you request electronic / PDF delivery of the documents in your cover letter, the price PLUMMETS.  Rather than a .75 per page fee for copying (which I had run to $1,500 in one case), they charge a flat $10 + the order processing / research time (almost always less than $100).
