Greetings colleagues -
I'm at post-ESP economic mediation in a case and there's a legal question that may be holding up final resolution. I don't want to be unreasonable, but obviously want to get best deal for the client. Without saying which I represent, how would a court calculate CS when:
<x-tab> </x-tab>Parties have three children.
<x-tab> </x-tab>Dad has 50/50 custody of two of them, and zero overnights with mom on the third child.
<x-tab> </x-tab>Mom earns more than dad.
Would support be run:
<x-tab> </x-tab>1. Run the CSG with two children at 50/50 (Example: mom pays dad $15 per week)
<x-tab> </x-tab>2. Run the CSG with one child at zero overnights (Example: dad pays mom $225 per week)
<x-tab> </x-tab>Net out the numbers (Example: $225 - 15 = Dad pays mom $210 per week)
or
<x-tab> </x-tab>1. Run the CSG for three children, but using an average on the overnights (365 total overnights - 186 child 1, 186 child 2, 0 child 3) = 122 overnights.
I don't think this is contemplated by the CSG. Is there any law / rules / case law on the "right" way to do this?
