  • 1.  spending assets to avoid paying alimony

    Husband was paying alimony but became disabled and is collecting SSD. Wife is also disabled and collecting a much lower amount of SSD. Husband filed a motion to amend alimony based on changed circumstances.  However, he spent over $200,000 in assets (mostly from inheritance and IRAs) while motion/discovery was pending.  It is obvious he did so to avoid paying alimony.  Does anyone know of case that is on point regarding good faith or intentional depletion of assets to avoid paying support?

    I thought of that 2012 case Clark v. Clark expanding on Mani v. Mani (2005) about wife's egregious conduct and an alimony claim. H's conduct here must fall under egregious conduct albeit post-judgment.

    There is a case (Weiss v. Weiss?) H squandered $500000 gambling. Court said his hands were so unclean they shoud be "cut off" or  words to that effect
