Mother could make a Will naming the oldest son as guardian of the younger two, jointly with the father.

Hi all.
A lawyer I know (who does not handle these matters) contacted me after he was contacted by a clergy member. Clergy member is trying to help a family.
Warren County. Family is struggling and in Section 8 housing. Mother is dying and expected to pass within a few weeks. 19 year old son of mother would like guardianship of his 2 siblings who are minors but in high school. Father lives in Newark and is fine with it. Mother is fine with it. They all want the children to remain together and do not want to risk separation.
I do not know if this is ripe for kinship guardianship? (not sure if they satisfy the 12 month care requirement).
Clergy was originally looking for attorney who would take pro bono.
I am not handling this matter...just looking for some general advice to pass along.
Any advice greatly appreciated.
