  • 1.  Service to Attorney with NY office

    Hi all,

    I have an adversary practicing out of a New York office, but lists an office in New Jersey on his website.  The issue is I want to use Lawyers Service to send my client's Reply Certification, so I need a NJ address.  My adversary rudely asked me not to serve him in NJ, but to serve him in NY.  

    I know the Court Rules no longer require you to have a bona fide office in NJ, but does that mean we're required to serve papers to our adversaries out of state?

    By rule, they must have an address in NJ to receive service of papers or they have to designate the clerk of the court.  I have a NJ and NY office and but work out of NY mostly. My adversaries generally serve me in NY if I ask but if they person is being a jerk, you have no obligation to serve him in NY and he is in technical violation.
