    What are the requirements to serve a post-disposition FD motion on the non-moving party? Two copies to the non-moving party? Or does the court serve it?

    Since the court schedules the return date, should anything be said in the cover letter to the adverse party to that effect?

    Robert,
     
    I customarily make it known to the adversary that the court will provide
    a date in the near future and they will get notice when it becomes
    available. When I receive the date from the court, I send the scheduling
    notice via CRRR and regular mail.  This stops the adversary from saying
    that they were never notified.

    It is a strange system. Ocean County told my secretary they do not send out a copy of the actual application to the adverse party and it's up to me if I want to do that.So to avoid a claim that there was no notice, I am sending out i by CMRRR and the other by regular mail with a cover letter that the court will schedule a hearing date.

    I have a similar question, I tried serving FD motion by regular and certified mail (both were returned), and by subpoena service (they can't find him even with skip trace).  Will I need to file an Affidavit of Diligent Inquiry before the return date?

    I'd file a motion as if it were an FM and directly serve the other party. Leave the return date blank. Let the Family Part figure it out. If you don't actually serve the other party directly, the other side won't get it because the Family Part won't serve them; they just give a notice. But once you get the one-page notice in the mail, you'll have your return date.

    I have a similar question. Is there a different service procedure for someone in a rehab facility? Can I just send certified and assume they give it to the person? Thanks for any advice?

    Sure. Why not? I'm sure the patient gets other mail there as well.
