    Lawyer Well Being and Its Effect on Professionalism and Ethics

    Ours is a helping profession, but one that can challenge even the most competent of practitioners. The hours are long, the clients often difficult, and the workload is sometimes crushing. Those issues, coupled with pressures from personal obligations, can weaken a lawyer's wellness making him or her susceptible to depression, addiction, and other conditions. These conditions can undermine a lawyer's competency, skill and professionalism, and possibly expose an attorney to malpractice liability and disciplinary measures. At this informative program, three highly-regarded professionals from New Jersey's Lawyer's Assistance Program (NJLAP) will discuss the importance of mental wellness in the practice of law, and will provide you with practical strategies to achieve balance in your personal and professional lives.

    William John Kane, Esq., the Founder and Executive Director of the New Jersey Lawyers Assistance Program (NJLAP) will review how unaddressed problems can impact practices and subject attorneys to ethical and professional difficulties. He provides guidance about what to do if you think you, or a colleague, needs help. He discusses how attorneys can take care of themselves while they take care of others, so they practice ethically and competently.

    Neuroscience presents new discoveries and theories about brain functioning. Ray Ortiz, Esq., a NJLAP Attorney Coordinator for 20 years, will describe some aspects of neuroscience addressing details how brain function can impact decision-making and conduct.

    In addition, Noreen Braman, the Program Manager for the NJLAP, demonstrates how kindness and humor can enhance your sense of well being and have a positive impact mental state and demeanor.

    • The attorney discipline system in New Jersey

    • Affirmative (and even fun) steps to take to enhance your sense of well being and mental health

    CLE Credits:
    NJ CLE information:This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 4.0 hours of total CLE credit. Of these, 4.0 qualify as hours of credit for ethics/professionalism.
    NJ CLE: This program has been approved for 4.0 credits (50 minute hour), including 4.0 ethics/professionalism credits
    PA CLE: 3.0 ethics credits pending ($12 fee – separate check payable to NJICLE must be submitted at the end of the program)

    Pushing Buttons - Using the Bad Character of Others to Your Advantage
    Presented by NJICLE in cooperation with the Professional Education Group.

    Narcissistic patterns can be hard to spot, leading to anxiety, prolonged cases, increased expenses, decreased energy, losing a client's confidence, and other challenges, even legal malpractice. It is important to learn how to identify narcissistic behavior, how to navigate and deal with such behavior, and how to use it to your advantage when possible. Lisa A. Marcy, Esq. and Tina M. Weber, Esq. offer real-world advice for dealing with narcissists inside and outside of the courtroom, including tips on depositions, trials, mediations and negotiations, and simply everyday life.

    Lisa A. Marcy is a managing partner of Clyde Snow & Sessions, in their Connecticut and Utah offices. Tina M. Weber is a trial attorney in solo practice in Exton, Pennsylvania.

    A Comedic Review of Recent Supreme Court Decision and Other Notable Cases

As an attendee, you'll laugh your way through this fast-paced program – all while picking up strategies to avoid some of the most common ethics issues you're likely to face in your practice.

    A seasoned constitutional attorney, Joel represented the town of Greece, N.Y., in the landmark constitutional case Galloway v. Greece. Oster argued the case before the United States District Court for the Western District of New York and the Second Circuit, and he was part of the legal team presenting the case to the U.S. Supreme Court.

    The top 10 wackiest cases, and the legal lessons we can learn from them, including:
    • Koutsouradi v. Delta Airlines - Koutsouradi sued the airline for infliction of emotional distress (among other things), claiming that its boorish bagman had caused her to suffer "panic attacks and post traumatic stress disorder" when her privacy was violated.
    • Liebeck v. McDonalds – A look at the case of the 79-year-old woman who was severely burned by McDonald's coffee she spilled in her lap, and was unfairly held up as an example of frivolous litigation.
    • Reinfeld v. University of Idaho - A student's case against university after he mooned other students out of his third floor dorm window and fell out.
    • Dougherty v. Home Depot – Mr. Dougherty was literally glued to his toilet seat, as someone had coated it with super glue before Mr. Dougherty used it.
    BMW of North America v. Gore - After purchasing a new vehicle from an authorized Alabama BMW dealership, Ira Gore Jr. discovered that his new vehicle had been repainted.
