    My client's shared-parenting, ex-husband took the children to live in North Carolina without her permission 4 days before school starts. I'm going to file an OSC tomorrow Morris County for their immediate return. I'm thinking my causes of action are: Contempt of the MSA, violation of UCCJEA and violation of NJSA 2C13-4. Am I missing anything. Anyone have a sample OSC for return of children taken out of state?

    You really can't "violate" UCCJEA, it's a jurisdictional statute that gives you the right to have the dispute heard here if child has been removed and the child last resided here for the 6 months prior to removal

    Thank you for those who reached out publicly and in private.

     

    However, I feel it necessary to mention that a fellow attorney from this list reached out to my client this morning after I posted my question and rather shockingly besmirched my name and reputation for having solicited advice on an area of the practice I'd not encountered. Needless to say I'm flabbergasted at the ethical breach and lack of professional courtesy.

    Not surprised...I find that in the last year attorneys have done and say things that were just beyond the pale...I have only been practicing 16 years but this year I have encountered more bad behavior than the previous 15 years combined!!!!!

    <x-tab>        </x-tab>I'm really sorry to hear that someone from this list would do that. It's one thing to realize there's a "caveat emptor" aspect / risk when posting case details on the list, another to hear that someone would do what you're describing. I think most of us view this as a profession with honorable advocacy balanced with camaraderie. Hopefully it was someone young and stupid and who will realize how unprofessional it was and will apologize and learn from it. Also, for what it's worth - "what goes around comes around" - that's not the kind of karma I'd want to incur.
