    Has there been any rules or statutes on whether you have to dissolve a prior NJ Civil Union when the parties want to divorce after a NJ marriage?

    I concur with Felice. One count in your complaint seeking dissolve each. There is no automatic merger of the CU into the marriage.

    and if your same sex couple was together long enough that the got a domestic partnership from NJ or anywhere else, you have to include a count seeking to dissolve the  DP also.

    Two Counts in one Complaint; one to dissolve the CU, the other to dissolve the marriage. Two separate legal relationships IMO. Not aware of any statutes or rules to date specifically addressing the issue.
