Return rate for imputed investment income?

  • 1.  Return rate for imputed investment income?

    Is there a standard rate being used to impute investment income?  Other parent will be receiving $850,000+ from a PI case and we need to determine what income should be imputed from it (hopefully displaces the loss in income from the injury and hence no change in circumstances to lower support).  Source or cite would be helpful.

    This isn't necessarily a "once size fits all" calculation. Take a look at Overbay (2005 App Div decision - sorry don't have the site handy) and Stiffler, 304 NJ Super 96 (Ch. Div 1997). You should consider risk tolerance, which varies depending on age, employment status, sophistication as an investor, etc. A 60-year-old on a fixed income and health care issues will have a different risk tolerance than a 30-year-old stockbroker. Also, it may not be reasonable to impute income to the entire amount, depending on what the person intends to do with some of the funds (i.e., buy a house).
