  • 1.  resume maiden name years after final judgment

    I have a client who would like to resume her maiden name but she was divorced in 2008 (or maybe 2009). Is it possible to amend the Final Judgment with the name change or is it too late and she will have to follow the name change statute? I don't think her ex will have any problem signing a consent.  Thanks.  Debbie

    2A:34-21. Resumption of name or assumption of any surname

    The court, upon or after granting a divorce from the bonds of matrimony to either spouse, may allow either spouse to resume any name used by the spouse before the marriage, or to assume any surname.
