I represent an individual who lives with his wife and 8 year old son in a house owned by he and his wife. Wife's 22 year old daughter, who is married and has an 18 month old child, just separated from her husband approximately 4 months ago. My client and his wife allowed wife's daughter to move in with them temporarily when she and her husband separated. Daughter just filed a TRO against my client and got him removed from the residence. In addition to it being his home, he is also self-employed and his office is in the basement of the house. Is there any case law, etc., which holds that even if he is found guilty of domestic violence, that the daughter would be removed from the house so that he could go back to living in the house with his wife and 8 year old son and conduct his business from his home office?
