  • 1.  Render counsel fees non- dischargeable in bankruptcy

    My pro se adversary was ordered to pay counsel fees for my client directly to me as a result of an FD application.  He then filed chapter 7 and included it. After speaking with trustee i was informed that i just need the family court judge to render it non - dischargeable.  Has anyone done this? Do i need to file a motion?  submit a brief?

    Consult a bankruptcy attorney.

     

    It had been my impression you may need to file a complaint objecting to the discharge of the debt on the basis that it is in the nature of support. However, I have not dealt with this for years and the bankruptcy code has been changed since that time.
