Parties divorced in England after several years of living there. They lived in Mississippi many years ago, during which time a 401k was accumulated. Company is saying ERISA requires a USA court order. So, we need a Mississippi attorney who can domesticate / register the UK divorce judgment and submit a QDRO (by consent) thereafter for entry.
Thanks,

A few months ago, I researched a similar question with a Canadian resident who had never lived in the US. I believe the result was that the foreign judgment should be registered where there is jurisdiction in the US, and then a QDRO could be filed. The Canadian resident had never lived or worked in the US so the jurisdiction issue was unclear, but if your client lived in Mississippi, filing the QDRO there may be possible.
