    I think the issue is different.  RTF is required because otherwise, property transfers would read as minimal consideration and no income to the State.  There is an exemption for interspousal transfers; that exemption should probably be deemed to extend to civil union partners, and gay marriages, but no one has confronted the issue with the recording offices that I know of.
