  • 1.  Question Re: DCPP records

    Hi everyone, Has anyone prepared a Motion requesting that DCPP be ordered to produce a copy of their file?  We were told by the AG's office that a Subpoena wouldn't suffice for them to testify nor can we request an in camera review without a Motion.  I am wondering if anyone has filed a motion requesting a copy of the DCPP file and had any success with same.

    I've done it before. It's fact-specific, but the judge was willing to review the records in camera, and he said he would release them if anything was directly relevant. I just tacked it on to a different motion I was filing.

    You have to make a motion for the Court to order them for in camera review.  The judges should have a standard order.

    After the Judge reviews them he or she decides whether counsel can review them and what to  redact (if anything).

    Pro se litigants have to be watched by staff when reviewing records.

    Some judges require counsel to be observed, others trust counsel to review them and return them.

    No one is allowed to make copies.
