I am suspecting that the answer here will be – call a QDRO expert. I represent Plaintiff-Husband, divorce decree has a lump sum being transferred by QDRO to former wife. His employer changed the plan administrator from Vanguard to TIAA-CREF about 5 months post-complaint.
Since I had a lump sum and TIAA has a QDRO form they want us to use, I thought I could do this one without an expert. I seem to have bit off more than I can chew, however, as TIAA can't segregate the amount as of DOC, and calculate gains or losses on that amount since DOC, since the funds which were not in their hands on that date. I have DOC value from Vanguard and the value on the date when the account was transferred, but no information as to post-complaint contributions. Even if I get the post-complaint contributions, I would need a formula to calculate the gains on the segregated amount. Maybe I could get that from Vanguard. TIAA "just" wants to know the value of the lump sum amount when it was transferred to them, and doesn't want any of that past history in "their" QDRO. However the QDRO as TIAA is asking me to draft it wouldn't reflect the requirements of the divorce decree.
If you have managed to read this far... any thoughts?
