  • 1.  Procedural: Need for motion to amend?

    Plaintiff / husband filed a complaint for divorce in January 2018.

    Wife filed an appearance (only) in March 2018. Wife had grounds to seek damages for assault (punched in the face, requiring surgery and is disfigured for life - her eye will be lower / sunk into her cheek. Not immediately noticeable, but if you're looking for it, it's obvious).

    Wife didn't want to pursue damages, against my advice. Just wanted it over with.

    Husband has been extremely difficult, playing games with asset hiding, fired his quite-capable attorney although he was financially able to keep her, not paying support, etc etc.

    Went to ESP in December and Husband rejected a very favorable recommendation.


    Wife at this point would like to pursue damages for the assault.

    If we'd filed a counterclaim before and he'd answered it, I know a motion would be required to amend it.

    But here, we'd only filed an appearance.

    Do I need a motion to "amend" it at this point and to pursue her counterclaim? Or can I just file the counterclaim?

    You need a motion to file a counterclaim. You attach the proposed counterclaim to your supporting certification.

    My gut says you're right, Robert, but if I'm going to have to motion the court, I'm not sure what the Rule to cite saying (1) I need to do this by motion, and (2) If leave is required, what the rule says about when it should be granted (I can guess the case law on lack of prejudice, etc - Ponden, et al). Is there a rule on this? The only one I can find is on amending a complaint, not amending / replacing an appearance with a counterclaim late in the game.

    Never mind. Got it. We had 90 days to file it without leave of the court. Need a motion. Thanks.


    4:9-1. Amendments
    A party may amend any pleading as a matter of course at any time before a responsive pleading is served or, if the pleading is one to which no responsive pleading is to be served, and the action has not been placed upon the trial calendar, at any time within 90 days after it is served.
