Cyber Risks and Related Litigation in Insurance Issues
Business Law Section and Insurance Law Section (Business and Tax Track)
Cyber risk is not a concern solely for the Amazons and Apples of the corporate world. Recent examples demonstrate that cyber risk can and will impact companies not directly operating in cyber space. This panel of speakers provides a legal and practical overview of cyber risks, potential liabilties and applicable insurance coverage. Topics include: high profile examples; why potential damages, litigation and regulatory costs make this an issue for the C-Suite level, business owners and service providers; significant court decisions on cyber-related claims; how specialty insurance policies can address coverage gaps under "traditional" policies; trends in the coverage area; practical considerations (such as mitigating risk from third-party service providers); and more.

Is Your Firm Cyber Compliant? The Dangerous World of Law Firms in Cyber Space
Privacy Law Committee, Hispanic Bar Association of New Jersey and Paralegal Committee (Special Interest Track)
Liability is everywhere for law firms - small and large - who are now more than ever targeted as sources for concentrated repositories of confidential and proprietary client information. Add cyber and data protection to the mix, and it can be an unclear and present danger. In fact, last month's New York Times article about an internal Citigroup report it obtained warned that law firms are at high risk for "cyberintrusions" and said that law firms have in fact been breached, but that it's hard to know the extent of the problem because most law firms are close-mouthed about it. Sound legal and insurance advice for lawyers can help to mitigate risk, but it cannot eliminate it. For the remaining risk, insurance is a time tested mechanism to provide piece of mind and economic assurance that allows law firms to operate without being crippled by fear and uncertainty.
The program takes the issue of Cyber Insurance from the perspectives of underwriting and compliance, namely - What does an insured prospect need to do to get its IT/InfoSec house in order so that the firm can get through underwriting without paying a fortune in premiums?

No Longer "If" But When! A Practical Discussion for Non-Technical Lawyers on Data Breach Preparation, Response and Government Collaboration
Intellectual Property Committee and the Internet and Computer Law Committee (Special Interest Track)
This is a theoretical case study of preparing for, responding to, and working with the FBI and AG"s office in response to a data breach/hack. We will walk clients through what should be in place before it happens, and then have a discussion on the best ways to work with the respective governmental agencies, what to turn over, what to turn over, what they are looking for, and what they aren't.
