  • 1.  Post Divorce Name Change - resume maiden name

    Parties were divorced 5 years ago.  There is a pending PJ matter regarding financial issues.  Can I file a cross to allow my client to resume her maiden name and/or can this be done by consent if we can resolve all the other issues of the motion?  I know that I can do a Motion to allow her to resume her maiden name, but since there is a matter pending I prefer to take advantage of that.  

    If can do by consent, does anyone have a form they wish to share?

    Years ago, PJ name changes were done by consent, but a motion (or, obviously, cross-motion) is generally being required these days (a filing fee issue, I suspect).

    Not sure why you would need consent to do a name change, since it’s up to the court and not the other side to permit same. In any event it is very simple provided you submit the required certification re not evading criminal or civil prosecution, payment of debts or bankruptcies and that name change is simply for personal reasons
