I am having a cohabitation investigation started regarding an ex-spouse who resides in Maryland and is believed to be cohabitating. Parties were divorced in NJ and my client still resides in NJ.
The private investigator wants to place a GPS tracking device on the ex-spouse's vehicle in Maryland as part of his investigation to document her her comings/goings with respect to her suspected current residence with her boyfriend.
The PI advises me that GPS tracking devices are legal to use in Maryland by a private investigator so long as the subject does not become aware of the tracking while it is ongoing. I don't know this to be accurate.
I am hesitant to authorize the use of a GPS tracking device on the ex-spouse's vehicle in Maryland where she resides.
This matter has a hostile history and I do not want to subject my client to the risk of having a TRO/FRO issued against him. I also don't want the evidence that the investigator gathers to be ruled inadmissible if the Courts deems it illegally gathered.
Anyone have any thoughts or prior experience with this sort of issue?
