  • 1.  Out of State child support judgment

    Good afternoon everyone, 

    I have a case with a Vermont child support judgment. The judgment is payable to the State and not the Payee. the State of Vermont has agreed to reduce the judgment, but before I send a check, i want to ensure that there is something in NJ evidencing that agreement. Is this something that I can submit via a consent order with the State Rep signing off? 

    I just don't want to send the check and then have my guy get arrested here in NJ for failing to pay in full.

    Sounds like you need a release and Warrant to Satisfy the Judgment more than an Order - release signed by the payee - if she is to receive the funds from VT and the Warrant from VT agency  - your client then has proof of the payment in full of the judgment and his credit record would reflect the payment as well.  Those docs should be proved in advance to be held in escrow pending payment and clearance of check.
