  • 1.  OPRA request or subpoena records from courthouse?

    I have a client who represents that his wife is a plaintiff in both a personal injury and workers compensation case, for an injury she sustained during the marriage. Of course, he does not know the docket number, attorney or county in which she filed for either of those cases. She represented in her discovery responses that she was not a party to any pending or past litigation.

    I was wondering if anyone has ever subpoenaed or sent in an OPRA request to a county courthouse to determine if there is pending litigation involving a specific litigant.  If anyone has any suggestions they are willing to share, I am all ears!

    <x-tab>        </x-tab>The judiciary (including the AOC) isn't subject to OPRA. There's something called the "common law right of access" that you can cite to and potentially sue based on (as I may in my ongoing quest to get a copy of the documentation provided for judicial college) but you don't need to go there. 
    <x-tab>        </x-tab>Just go to http://www.judiciary.state.nj.us/  and look on the left side of the page. The Civil Case Public Access should have the info. <x-tab>        </x-tab>The Judgment lien search option (and criminal conviction info) also come in handy at times.

    Get a private investigator to do it.  lawsuits are public record
