  • 1.  Obtaining a Death Certificate

    Was preparing a motion to reduce and/or terminate Alimony for a recently retired client when the ex-wife suddenly passed away over the weekend.  Need to obtain a copy of the death certificate but the parties children are refusing to give a copy to their father. Children are all older/emancipated and have terrible relationship with my client.  We contacted the funeral home and will not provide one.  We also contacted the Registrar of Vital Statistics in the township where she passed and they said they can't provide a copy to client since he is her former husband and can't provide one to my office.  Something doesn't sound right about this.  Anyone have any idea how I can get a death certificate for her so I can provide same to probation and end alimony.  This is a first for me. Thanks in advance.

    You need a Court Order for the Release of the Death Certificate.  You can make a motion to the Family Court for this.
