  • 1.  obligation to pay for son's criminal attorney's fees?

    Post divorce - unemancipated college student -  arrested again for some minor drug violation. Is there an obligation by either parent to pay for the criminal attorney's fees to represent the son? If so, statute? Case law? I have not come across this and would appreciate any guidance. And, I have suggested it's time for the son to pay himself, but he is swamped by college courses, has a small job, but has no time to take on more to pay the fees himself. Just looking to see if there is some legal obligation for the parents to pick up these fees.

    No obligation.  Son may qualify for municipal public defender.

    If son is over 18, he is eligible and may well qualify for Muni Public Defender.  Probably run him 50 bucks to apply.

    If son is under 18, he may qualify for PD.  However, some municipal court judges may deny application if he is living at home and supported.  the statutory fee for acceptance of the application is $75.00 to $200.00 at the discretion of the municipal court judge.  The question I have is:  has he been asked to pay for the fees?  Has there been a motion to require his payment of fees?

    At that age, I can't see a father being obligated.
