  • 1.  NY realty transfer fees

    I have just been told that in New York there is FULL transfer tax when property is transferred between husband and wife  incident to divorce.

    Does anyone know if this is accurate?  if so, is there any (lawful) creative way around it?

    Any help would be greatly appreciated.

    This is true.
    For New York CITY, I am not aware of any way out of this.
    For New York STATE, some real estate attorneys feel that this can be avoided if the transfer happens when the couple is still married. But I am not sure if this is true, as others disagree.
