  • 1.  Notice Requirement for Child Support Judgments

    Dear ListMates:

    I have a question as to the notice requirement for child support judgments:

    Is the act of providing notice to the County Probation Department, as to settlement proceeds from a discrimination lawsuit, required prior to distribution of settlement proceeds, where plaintiffs in the discrimination lawsuit have child support judgments?

    Assuming notice is required, is it the responsibility of counsel for defendants or counsel for plaintiffs in the discrimination suit? In this particular case, defendant's insurance carriers are to make payment of settlement proceeds directly to counsel for plaintiffs.

    Any guidance from past experiences would be greatly appreciated.

    Plaintiff's counsel is required to run a child support judgment search and pay off judgments if the recovered amount is greater than $2,000.

    You do a child support judgment search and you as plaintiff's attorney are responsible to get payoff figures for the judgment(s) and get warrants to satisfy judgment which are to be recorded. Client is entitled to a minimum of $2000 from the settlement proceeds.
