We survived the Blizzard of 2016!
I received a call this morning from a nice lady in the Middlesex County Family Court clerk’s office informing me that I needed to fax her a “notice of appearance” and a cover letter to charge our Superior Court account for the filing fee of $50.00.
I was retained by a Florida resident who had been divorced in Middlesex County over 10 years ago. His ex-wife had filed a motion against him requesting an increase in child support for their son and contribution to auto insurance, etc. On my client’s behalf, I filed a cross-motion last week opposing the relief sought by his ex and seeking an enforcement of litigant’s rights for not paying her share of timeshare fees they are supposed to split.
So, for me to represent my client in this case, it costs him $100.00 in filing fees and it cost the pro se ex-wife $50.00. It was confirmed to me that pro se litigants do not have to file a notice of appearance, even if formerly represented by counsel, but I had to file one. I should add that I was not my client's counsel in the divorce action and I don't believe there have been any post-judgment motions filed in this case prior to the present filings.
Something is rotten in the State of NJ.
