  • 1.  No PPR who pays first $250

    Where there is no PPR and 50/50 parenting time, husband (lower wage earner ) originally received no child support and PSA  said wife (who was the higher wage earner) would pay the first $250 in medical bills. 

    That agreement was subsequently amended so the wife now pays child support. Nothing was amended regarding wife paying the first $250 in medical expenses. Would wife continue to pay the first $250 in medical expenses pursuant to the original agreement? Or- would husband automatically have to pay the first $250 because he is the recipient of child support?

    It is my understanding that if the child support is based on the child support guidelines then uncorporated into that is that the payee pays the first $250. There is no reason that you cannot not follow the guidelunes and impose your own agreement

    The recipient of the child support would be responsible for the  first $250. The first $250 is included in the child support payment according to the guidelines.

    Check out NJ Court Rules Appendix IX-A, Section 8, entitled Expenses Included in the Child Support Schedules:

    Unreimbursed Health Care Up to and Including $250 Per Child Per Year - Unreimbursed health-care expenditures (e.g., medical and dental) up to and including $250 per child per year are included in the schedules. Such expenses are considered ordinary and may include items such as non-prescription drugs, co-payments or health care services, equipment or products. The parent's cost of adding a child to health insurance policy is not included in the schedules.
