Emancipated? The Rights of Young Adults & Parents in the Wake of the Rachel Canning Case - A Webinar on Tuesday,
April 29, 2014 from 12 to 1:40 p.m.
The
Rachel Canning case has ignited a national legal debate surrounding what it means to be emancipated and what duties and/or support obligations intact and divorced families owe to their young adult children.
In divorced families, there is no fixed age when support ceases. Depending on previous agreements and the current circumstances of children, support can be judicially ordered to continue after high school and involve obligations for college tuition or vocational training, and in some instances, even graduate studies.
The law regarding ongoing support for "children" 18 and older of intact families is not as clear.
• Are parents required to put up with rebellious young adults or may they be shown the door?
• Do they have an obligation to continue supporting children who have voluntarily removed
themselves from their home?
• Do they have an obligation to pay for education after age 18 and/or after high school?
Since support is the right of the child, some argue that all parents should have the same support obligations for teens and young adults regardless of their marital status. Others argue that children of divorce are entitled to a higher level of oversight and protection as the state is acting parens patriae, and may intervene in family matters of divorcing couples, even if that means children of intact homes are treated differently under similar circumstances.
