  • 1.  New rule 1:4-1(B)

    I am revising the ICLE Family Law Skills Book .Any idea how the caption should read when filing. The attorney of record and ID is first. The attorney and ID who is filing is below that. The rule isn't clear whether to include the firm's name under that, although it does require the attorney or firm address. Should the firm name be included?

    There was a notice to the bar in late August (somewhere around the 25th, I think) providing guidance.  If anyone went to the last weeks'  ICLE seminar re: the rule changes, it was part of the course materials.  The ID # should be that of the attorney signing the pleadings. If a different attorney is designated trial counsel, that attorney's name and ID # should be in the caption also.

    Below is the sample I received from the AOC in response to an inquiry I made a while ago.

    Also, perhaps more importantly, below is an email I sent to Judge Grant this morning.

    Judge Grant -
            I write in reference to the new requirement that attorneys provide their attorney ID number on pleadings.  If there was an opportunity for the public / bar to submit comments on this change, I missed it.
            If it's not too late to do so, I respectfully suggest that requiring the number to be placed above the caption is an unwise way to go about this.  Firms with standard letterhead and captions are going to have problems identifying which attorney ID number to use.  Cases with more than one attorney (co-counsel and multi-attorney cases) are going to be similarly confounded.  Additionally, it ruins the aesthetics for many attorneys to include the extra line above a caption.
            I respectfully suggest that the proper way to do this is to follow the model used by the federal court:  An attorney ID# is to appear below the signature of every pleading signed by an attorney.
            Thanks for your time in considering this issue.
