New Filing Fees

    Has anyone encountered a clerk(s) requiring a filing fee under the new fee list for things such as a Substitution of Attorney?

    Yes, I have. I just paid $50 today to file a substitution. It was
    effective 1/16/15 I believe.

    It is possible if the substitution is the first paper filed by anyone other than the Plaintiff.

    Yes. This just happened to me in Morris County. It is ridiculous that they are charging $35.00 for filing a simple Substitution of Attorney.

    Yes, we did. Had to pay $35 even though not on fee sheet.

    The clarification of the Rule states that "There is a $35 fee for substitutions of attorney under the 'recording instruments not otherwise provided for...'". My question would then be is there supposed to be a $35 filing fee to file a CIS in the family part since that too would fall under the "recording instruments not otherwise provided for..." catch-all? I know I haven't had one returned yet, but it doesn't seem to make sense that there would be a filing fee for Sub of Attorney but not CIS.

    You can get a copy of the new schedule of fees from the Lawyer's Diary online.  In addition to a bunch of things that never had fees before, almost all of the fees went up.

    There was a notice posted about this. Yes, there is a $35 fee for a substitution of attorney.

    Where does it end? Will QDROs be required to have a fee? CISs? Reply certifications? This smells of overreach and a tax on attorneys and litigants.
