  • 1.  New Filing Fees

    Ordinarily, I don't like to see new fees, but given what we all know - that the State has underfunded and ignored the Judiciary for decades, especially more recently with a lawyer/governor who apparently disdains the bench, I will be more concerned if those newly increased and created fees do not within a relatively short time produce the technology and Legal Services benefits they were intended to do.

    How can we expect a 21st Century court system on 1980's pricing?  Taxes and fees are necessary to maintain civil society and governmental services.  The real question is - are the taxes and fees be used efficiently and properly - are we getting what we are paying for?

    I had the same thought / question as Kristin Lis -- are consent orders subject to a fee as well?

    If not, how about instead of filing a substitution, one files a consent order on new attorney's letterhead relieving prior attorney as counsel, without specifying further.  I wonder if they would catch that and/or if it would be legitimate?

    Let's say you have 20 or 30 files in some form of active litigation and you have just merged practices with another lawyer and formed a new firm. You now have to file substitutions of attorney on each case substituting in your new firm. You pass this cost on to the client in each case even though from the client's perspective, you were and still are the client's attorney. Problem?
