  • 1.  Motion for Reconsideration ?

    Hello everyone,

    Just met with new client and want to file a Motion for Reconsideration but have a quick question.  Client appeared in Monmouth on the issue of having the former spouse sign the 2012 tax returns (extension filed by accountant).  He attached e-mails that were sent to and from his former spouse showing that two months ago she had not signed the return.  When the judge asked her if she had since signed, she said that she did and the judge deemed the issue moot based on her testimony.  I want to get a Certification from their accountant stating that they remain unsigned but since the clock on the MFR runs on Monday, was wondering if this would be something better handled by motion.  Any thoughts or suggestion would be greatly appreciated.

    Eric: Call accountant Monday morning and file motion and have it hand delivered AND served the same day. How doesyour client know the returns were not signed?     As I was enjoying my morning coffee, I read the following line from Bob Goldstein, "Does your client think his wife would commit perjury in open court?" and did a spit take. I hope you were kidding, Bob. Cheers.
