  • 1.  Monmouth Vicinage Parents Education Act seminar

    Hi, all:

    I filed a complaint and clearly indicated the parties already had an MSA. The prayer for relief did not request custody be awarded.

    We got the complaint back filed and a notice for my client to attend the parenting seminar. We questioned this and were advised that I have to write to the Judge asking for my client to be excused and to have a refund issued.

    This seems ridiculous. Do all the counties do the same thing?

    I have had the same issue in Ocean County.  A letter to the presiding judge usually works.  I think the statute is clear that it is only necessary where custody is an issue.  I had to request a waiver when the child was over 18 and the parties had a signed PSA.

    Yes. if there are children the parties are required to pay the fee and attend the seminar regardless.

    I have always had to pay the fee, but the court will usually acknowledge a signed agreement ( either MSA or custody and parenting plan) and excuse your client from attending the seminar.

    Not in Mercer. They returned the $25 fee to me immediately when I submitted a complaint requesting the Court to incorporate the MSA into the JOD (there were kids under 18 too).
