  • 1.  Mediator / Mercer or northern Burlington

    I have a matter with a general practitioner where there's custody / shared custody / parenting time / parenting issues. He has very cleverly deduced that we cannot use a mediator I know (either personally, as a mediator, or as an adversary) since he/she/they could not possibly be fair if they've had any direct interaction with me (cause I'm just that charming? LOL). I'm sure the guy does a great job with real estate closings or whatever else he does, but rather than fighting this ridiculousness --

    Anyone on this list in southern Mercer or northern Burlington county who is an experienced mediator in a potentially high-conflict custody matter who doesn't know me in any of the above roles (I hope there's at least one!), please advise, on-list or off.

    I second Gary Borger. You can also try Christopher Musulin, who everyone knows in Burlington and the judges appoint often, but I have a feeling you may have had him as a mediator or adversary in the past. Michelle Ringel is another good choice. Good luck.

    <x-tab>        </x-tab>I would love to use Gary, but I've had him and his firm as an adversary in several cases, and recently used him as a mediator (where he stayed, btw, until after 10:00 p.m. in order to settle a tough case - kudos). Chris is also out, not many with him personally, but several with his firm over the years.    But thanks for the suggestions.   This may be a tough case. The mom attended therapeutic mediation with a tip-top family law therapist (Roberta Pughe in Princeton, if anyone needs someone) and decided she was "being ganged up on" - won't further attend non-attorney mediation and wants her lawyer there, won't talk about the issue directly with dad "on advice of her attorney" (which I hope isn't true), and has taken the position that shared parenting is "out of the question" with no reason a judge would consider valid.  Dad has bent over backwards to try to get this done (offering her every Christmas, agreeing to a private school he doesn't like, more money than the CSG call for, etc).
    <x-tab>        </x-tab>Point being, the more training and experience with tough cases, the better.

    Don't make this more difficult.  Your adversary is being ridiculous and unreasonable. Ask the judge to pick one if you adversary will not agree.

    Dave,
    If you are looking for someone with experience with tough cases, then contact Ray Batten.  He was the family court judge for years in Cape May County and presided over numerous difficult custody cases.  Sounds like Ray will satisfy your adversary's requirement that the mediator be completely impartial and not someone you've worked with before.
