  • 1.  Mediation Statements

    Posted 06-30-2020 02:20 PM

I have an upcoming mediation where the only contested issue is custody and parenting time.  I know when you participate in economic mediation, you must exchange mediation statements, and financial information, with your adversary.  Do you have to exchange mediation statements when there are no economic issues?

    Thanks,

Have all the financial aspects of the divorce been resolved ?  if so, prepare a consent order for the mediation so that it can be signed and send it to the mediator and tell them it is resolved.  if you want the mediator to help you with the custody and parenting time, tell them that in your letter.  How did you calculate child support without the custody and parenting time being resolved?

so, yes, you must prepare something for the mediator to tell them what is going on with the case.

Since I serve as a mediator in cases, I ask that you don't want to waste the mediator's time. Talk to your adversary and find out if you both agree not to participate in mediation. If Equitable distribution and alimony are resolved put an agreement together.  find out if the adversary and the mediator will use the mediator for custody and parenting time.
